Partner Program Terms

1. Who is who

The affiliate program you join is run by the store that invited you (the "Store"). Kirill Novak s.r.o. provides the software the Store uses (Hypesoul); we are not a party to your agreement with the Store, we do not pay commissions, and we are not your employer, agent or partner.

The Store decides who can join, the discount shoppers get, your commission rate and when it is paid. Those terms are shown to you on the program rules page and in your dashboard. If the Store's own written rules conflict with these Partner Program Terms, the Store's rules apply to the commercial terms and these terms apply to the use of the software.

2. Joining the program

• You must be at least 18 years old, or the age of majority where you live, and able to enter a contract.
• Give true information. Your email address must be one you control; you confirm it by link.
• The Store may approve, reject or later disable your account. A disabled account stops earning from new orders.
• Keep your password private. You are responsible for what is done with your account.

3. Links, codes and commission

You receive a discount code and one or more tracking links. A sale counts for you when the order is paid and carries your code. Commission is a percentage of the merchandise total of the order after discounts and before shipping and taxes.

If an order is refunded or cancelled, the commission on the refunded part is deducted, including from a later payout if it was already paid out. The Store may exclude an order that breaks the rules, for example a self-referral or an order that is not genuine.

A commission is a claim against the Store, not against us. Numbers shown in your dashboard are an aid and are not a guarantee of payment.

4. Payouts, payment details and taxes

The Store pays you outside the app by the method you agree with it, or with a one-time discount code. The Store may set a waiting period before commissions become payable and a minimum payout amount.

If you choose to add payment details (for example a PayPal address or an IBAN), they are stored encrypted and shown only to the Store when it pays you. You can delete them at any time. Add only what is needed to pay you.

You are responsible for your own taxes, registrations and reporting on what you earn. We do not give tax advice.

5. Promoting honestly

• Say clearly and visibly that you are an affiliate and earn a commission when people buy through your link or code. Put it where people see it before they click, for example at the start of a post, in a video's spoken intro and its description, or next to the link. A hashtag hidden among many others is not enough. Follow the advertising rules of your country and of the platform you use.
• Do not make claims about the Store's products that are false, misleading or not allowed (for example medical or guaranteed-result claims).
• Do not send unsolicited bulk messages, buy traffic that disguises its source, or use fake accounts, bots or incentives that create fake clicks or orders.
• Do not bid on the Store's brand name in paid search, impersonate the Store, or publish the discount code on coupon sites unless the Store allows it.
• Do not use another person's content, pictures or music without the right to do so. Materials the Store gives you may be used only to promote the Store.
• Do not buy through your own link or code to earn commission, unless the Store allows it.

6. Your data

We process your data as a service provider for the Store, which decides why it is needed. How the app handles personal data is described in the Privacy Policy (/legal/privacy). To see, correct or delete your data, write to the Store; you can also write to Bochichenko@gmail.com and we will pass your request on.

7. Ending the relationship

You can stop at any time by asking the Store to disable your account and by removing your links and codes from your channels. Commission earned before that date stays payable under the Store's rules.

The Store can end your participation if you break these terms or the Store's rules. We can suspend access to the software for security reasons or when the Store ends its use of the app.

8. Liability

The software is provided as is. To the extent the law allows, Kirill Novak s.r.o. is not liable for lost earnings, for the Store's failure to pay, for outages or for indirect loss, and its total liability to you is limited to EUR 100. This does not limit liability that cannot be limited by law, and it does not affect rights you have as a consumer.

9. Changes and law

We may update these terms; the date at the top shows the latest version. Continuing to use the dashboard after a change means you accept it.

These terms are governed by the laws of the Czech Republic, subject to any mandatory consumer rules of the country where you live.
